As a landlord or a managing agent acting on behalf of the landlord, you are probably responsible for maintaining the property to keep it in good condition and free of dampness. This includes carrying out any necessary repairs and annual maintenance, to keep the property free from damp or associated timber decay problems. DAMP & TIMBER DECAY – WHO IS RESPONSIBLE?
There is sometimes confusion between tenants and landlords about who is responsible for any damp or timber decay but much of who is, will obviously depend on the terms of the lease. However, recently the law has changed and it has become the responsibility of the landlord to ensure that the property is kept free of damp and risk to their health, Generally problems such as Rising Damp or Lateral Damp Penetration from the ground, damp from leaking roofs or other defective maintenance, have always been the responsibility of the landlord or freeholder, because they are structural defects. Any timber decay caused by these defects are also likely to be the responsibility of the landlord. However, if the problem is Condensation (high humidity) it is quite often being caused by the tenants life style and the failure to control it by opening windows and keeping the property at a constantly warm temperature.
A thorough investigation by one of our Property Care Association (PCA) qualified damp & timber surveyors will include using a calibrated damp meter, hygrometer and thermometer. These devices will determine the cause of the damp, what needs to be done about it and what or who is responsible for it. If necessary, floorboards will also be lifted in the location of any damp, to inspect for timber decay or woodworm.
